Christopher Clark, Hunter Biden’s principal attorney defending him in a federal criminal probe, will quit representing him since he might be summoned as a witness in the case after plea discussions broke down, according to a Tuesday morning court filing.
Clark, a well-known attorney who has also defended Mark Cuban and Elon Musk, filed a motion with the Delaware judge who has overseen the case.
“Based on recent developments, it appears that the negotiation and drafting of the plea agreement and diversion agreement will be contested, and Mr. Clark is a percipient witness to those issues,” Biden’s lawyers said in the filing.
Federal prosecutors said last week that negotiations with the president’s son on a plea agreement involving tax offenses and a related “diversion agreement” to resolve a charge of gun possession had come to a standstill. They asked the judge to revoke the late August deadline she had previously given both parties to renegotiate the agreements after she rejected them at a hearing last month.
The prosecutor in charge of the case, US attorney David Weiss, requested and was given “special counsel” status by Attorney General Merrick Garland when the plea negotiations broke down last week.
